1. INTRODUCTION

Thank you for choosing God Music (“GOD MUSIC”, “we”, “us”, “our”). God Music provides personalized services with social and interactive features for streaming Christian Music and other content, as well as other products and services that may be developed from time to time. By signing up or otherwise, to any of God Music’s services, including all associated features, functionalities, websites and user interfaces, content and software applications associated with those services (collectively, the “God Music Service” or “ Service”), you are entering into a binding contract with God Music.

Your agreement with us includes these Terms and any additional terms that you agree to, as discussed in the Entire Agreement section below, other than terms with any third parties (collectively, the “Agreements”). The Agreements include terms regarding future changes to the Agreements, export controls, automatic renewals, limitations of liability, privacy, waiver of class actions and resolution of disputes by arbitration instead of in court. If you wish to review the terms of Agreements, the current effective version of the Agreements can be found on God Music’s website. You acknowledge that you have read and understood the Agreements, accept these Agreements, and agree to be bound by them. If you don’t agree with (or cannot comply with) the Agreements, then you may not access the God Music Service.

In order to access God Music’s Service, you must (1) accept our usage Terms & Conditions and (2) reside in a country where our Service is available. You also promise that any registration information that you submit to God Music is true, accurate, and complete, and you agree to keep it that way at all times. Furthermore, God Music undertakes no liability in relation to a violation of Terms and Conditions of Use by you

2. CHANGES TO THE AGREEMENTS

God Music reserves the rights to make periodic changes to the Agreements for valid reasons, such as improving the existing functions or features or adding new functions or features to the Service, implementing advancements in science and technology, and reasonable technical adjustments to the Service, ensuring the operability or the security of the Service, and for legal or regulatory reasons. In case changes are made to the Agreements, users will be informed of the change by means of notification within the app or via email communication. In some cases, users will be notified in advance, and their continued accessing of the Service, thereafter would constitute their acceptance of the changes. Users are therefore urged to read these notifications carefully. If a user does not wish to continue using the Service under the new version of the Agreements, the subscription can be cancelled through the third-party service through which the subscription was made.

3. ENJOYING GOD MUSIC

Here’s some information about all the ways users can enjoy God Music

3.1 Service Options

Users can find a description of God Music’s services on the God Music website. The details of the services available to users will be detailed while a user account is being created within the app. We may also offer special promotional plans, memberships or services, that include offers for third-party products and services in conjunction with or through the God Music Service. We are not responsible for the products and services provided by such third parties. We reserve the right to modify, terminate or otherwise amend our subscription plans and promotional offerings at any time in accordance with these Terms.

If users have purchased or received a promotional code, gift card, pre-paid offer or other offers provided or sold by, or on behalf of God Music for access to a Paid Subscription (“Code”), separate terms and conditions will be presented to them along with the Code. The user agrees to comply with any such terms and conditions. Users may also purchase access to a Paid Subscription through a third party. In such cases, separate terms and conditions with such third party in addition to the Agreements may apply to their access to the Service.

3.2 Trials

In case of some Trials, users might be required to provide payment details to start the Trial. By providing these details, users agree that we may automatically begin charging them for the Paid Subscription on the first day following the end of the Trial on a recurring monthly basis or another interval that we disclose in advance. If a user does not wish to be charged, they must cancel the Paid Subscription before the end of the Trial. If they have signed up for the Trial through God Music, or if they have received their Trial through a third party, users are required to cancel the applicable Paid Subscription through the third-party service through which the subscription was made.

From time to time, God Music or others on our behalf may offer Trials of Paid Subscriptions for a specified period without payment or at a reduced rate (a “Trial”). God Music will determine users’ eligibility for a Trial, and withdraw or modify a Trial at any time without prior notice and with no liability, to the extent permitted under applicable law.

4. PAYMENTS AND CANCELLATIONS

4.1 BILLING

When a Paid Subscription is purchased directly from God Music or through a third party either by (1) paying a subscription fee in advance on a monthly basis or some other recurring interval disclosed prior to purchase; or (2) pre-payment giving users access to the God Music Service for a specific time period (“Pre-Paid Period”).

God Music may change the price for the Paid Subscriptions, including recurring subscription fees, the Pre-Paid Period (for periods not yet paid), or Codes, from time to time and will communicate any price changes to users in advance and, if applicable, how to accept those changes. Price changes will take effect at the start of the next subscription period following the date of the price change. Subject to applicable law, users accept the new price by continuing to access the God Music Service after the price change takes effect. If users do not agree to a price change, they can unsubscribe from the Paid Subscription prior to the price change taking effect.

4.2 RENEWAL AND CANCELLATION

PREPAY:

For Prepay Subscriptions, there will be no refund for cancellation and your Prepay Subscription will be valid for the subscribed period. Prepay Subscriptions will not auto-renew. Users will require to subscribe once again at the end of their current prepay subscription period.

SUBSCRIPTION:

All Subscriptions that are not under the Prepay option will automatically be renewed at the end of the applicable subscription period. In the case of cancellations through the respective App Stores, the validity of the subscription post cancelation are subjective to the individual stores’ cancellation & refund policies. To prevent auto-renewal on the respective App Stores, users are requested to initiate their cancellation 2 days prior to the date of next renewal. Please note that in some cases, subscriptions might be terminated instantly upon cancellation. Please refer to the respective App Stores’ cancellation & renewal policies for more details.

4.3 SUBSCRIPTION PLAN CHANGE

Users may upgrade or downgrade their subscription plans at any time. In case of an upgrade, the user, after selecting the new plan, would require to make a payment of the difference in cos of their current subscription plan and the new plan they are upgrading to (including taxes). Upon confirmation of payment, the new plan will be active. In case of a downgrade, the current plan will continue to apply for the remainder of current cycle and the new plan will be active from the following billing cycle.

5. ACCESS TO OUR SERVICE

The God Music Service is the property of God Music Private Limited. Users are granted limited, non-exclusive, revocable permission to access the God Music Service for personal, non-commercial purposes. This access shall remain in effect until and unless terminated by the user or God Music. Users are required to agree that they are accessing the God Music Service for their own personal, non-commercial use and that they will not redistribute or transfer the God Music Service.

The God Music software applications are not sold or transferred to users, and God Music and its licensors retain ownership of all copies of the God Music software applications even after installation on users’ personal computers, smartphones, tablets, wearable devices, smart speakers and/or other devices (“Devices”).

All God Music trademarks, service marks, trade names, logos, domain names, and any other features of the God Music brand (“God Music Brand Features”) are the sole property of God Music or its licensors. The Agreements do not grant users any rights to use any God Music Brand Features for commercial or non-commercial use.

Users must agree to abide by our Guidelines and not to use the God Music Service, or any part thereof, in any manner not expressly permitted by the Agreements. Except for the rights expressly granted to users in the Agreements, God Music grants no right, title, or interest to users in the God Music Service.

Third party software (for example, open source software libraries) included in the God Music Service are made available to users under the relevant third party software library’s license terms as published in the Help or Settings section of our desktop, mobile client and/or on our website.

Chord Sheets and MyVoiceTM (Karaoke Tracks) might not be available for all songs. New Music Classes are released every fortnight.

6. THIRD PARTY APPLICATIONS AND DEVICES

The God Music Service is integrated with or may otherwise interact with third party applications, websites, and services (“Third Party Applications”) and third party Devices to make the God Music Service available to users. These Third Party Applications and Devices may have their own terms and conditions of use and privacy policies and use of these Third Party Applications and Devices will be governed by and subject to such terms and conditions and privacy policies. Users require to understand and agree that God Music does not endorse and is not responsible or liable for the behaviour, features, or content of any Third Party Application or Device or for any transaction users may enter into with the provider of any such Third Party Applications and Devices, nor does God Music warrant the compatibility or continuing compatibility of the Third Party Applications and Devices with the Service.

7. CONTENT ON APP

All content will be uploaded or posted on the app solely by God Music. Artists, Musicians and Users do not have permission to upload any content such as pictures, text, messages, information, descriptions or compilations. Users are advised to report or contact the God Music team for any content to be generated on the app.

8. RIGHTS GIVEN TO GOD MUSIC BY THE USER

By signing up to or otherwise accessing the God Music Service, users give us the permission (1) to use the processor, bandwidth, and storage hardware on their Device in order to facilitate the operation of the Service, (2) to provide advertising and other information to users, and (3) to allow our business partners to do the same. In any part of the God Music Service, the Content, including its selection and placement, may be influenced by commercial considerations, including God Music’s agreements with third parties. Some Content, provided to, created by or otherwise made available by God Music (e.g. podcasts) may contain advertising as part of the Content. Such Content is available to users unmodified.

If users provide feedback, ideas or suggestions to God Music in connection with the God Music Service or content (“Feedback”), users acknowledge that the Feedback is not confidential and they authorize God Music to use that Feedback without restriction and without remuneration. Feedback is considered a type of User Content.

9. GUIDELINES

9.1 SERVICE GUIDELINES

God Music respects intellectual property rights and expects users to do the same. We have established a few ground rules for users to follow when using the Service, to make sure God Music stays enjoyable for everyone. Users must follow these rules and should encourage other users to do the same.

The following are not permitted for any reason whatsoever:

• Copying, redistributing, reproducing, “ripping,” recording, transferring, performing or displaying to the public, broadcasting, streaming or making available to the public any part of the God Music Service, or otherwise making any use of the God Music Service which is not expressly permitted under the Agreements or applicable law or which otherwise infringes the intellectual property rights (such as copyright) in the God Music Service or any part of it;
• Using the God Music Service to import or copy any local files that users do not have the legal right to import or copy in this way;
• Reverse-engineering, decompiling, disassembling, modifying, or creating derivative works of the God Music Service, or any part thereof except to the extent permitted by applicable law. [If applicable law allows users to decompile any part of the God Music Service where required in order to obtain the information necessary to create an independent program that can be operated with the God Music Service or with another program, the information users obtain from such activities (a) may only be used for the foregoing objective, (b) may not be disclosed or communicated without God Music’s prior written consent to any third party to whom it is not necessary to disclose or communicate in order to achieve that objective, and (c) may not be used to create any software or service that is substantially similar in its expression to any part of the God Music Service];
• Circumventing any technology used by God Music, its licensors, or any third party to protect the Service;
• Selling, renting, sublicensing or leasing of any part of the God Music Service;
• Circumventing any territorial restrictions applied by God Music or its licensors;
• Artificially increasing play counts, follow counts or otherwise manipulating the Service by (i) using any bot, script or other automated process; (ii) providing or accepting any form of compensation (financial or otherwise), or (iii) any other means;
• Removing or altering any copyright, trademark, or other intellectual property notices contained on the Service or provided through the Service);
• Circumventing or blocking advertisements in the God Music Service, or creating or distributing tools designed to block advertisements in the God Music Service;
• Providing user’s password to any other person or using any other person’s username and password;
• “Crawling” the God Music Service or otherwise using any automated means (including bots, scrapers, and spiders) to view, access or collect information from God Music or the God Music Service; or
• Selling a user account or playlist, or otherwise accepting or offering to accept any compensation, financial or otherwise, to influence the name of an account or playlist or the content included on an account or playlist.

Please respect God Music, the owners of the content, and other users of the God Music Service.

Users acknowledge and agree that posting any User Content that violates these User guidelines (or that God Music reasonably believes violates these User guidelines) may result in immediate termination or suspension of their God Music account. Users also agree that God Music may reclaim their username where it is reasonable for us to do so, including violation of the Agreements.

Users are urged to be thoughtful about how they use the God Music Service and what they share. The God Music Service includes social and interactive features, including the ability to post User Content, share content, and make certain information about users public. Remember that shared or publicly available information may be used and re-shared by other users on God Music or across the web, so please use God Music carefully and be mindful of your account settings.

The password protects a user’s account, and they are solely responsible for keeping password confidential and secure. Users require to understand that they are solely responsible for all use (including any unauthorized use) of their username and password on the Service. If their username or password is lost or stolen, or if they believe there has been unauthorized access to their account by a third party, users must notify us immediately and change their password as soon as possible.

9.2 CONTENT GUIDELINES

While accessing the Service, users may enjoy the music, videos or any other content or material (collectively, “Content”) for their own personal, non-commercial purpose.

The Content is the property of God Music or God Music’s licensors. The Content is not sold or transferred to users, and God Music and/or its licensors retain ownership of all copies of the Content and even after installation on users’ personal computers, mobile handsets, tablets, wearable devices, speakers and/or other devices (“Devices”).

Except for the permission to access the God Music Service for personal and non-commercial purpose as mentioned in the Agreement, God Music grants no right, title, or interest to user in the Content.

The following is not permitted for any reason whatsoever:

• Copying, redistributing, reproducing, “ripping,” recording, transferring, performing or displaying to the public, broadcasting, streaming, or making available to the public any part of the Content, or otherwise making any use of the Content which is not expressly permitted under the Agreements or applicable law or which otherwise infringes the intellectual property rights (such as copyright) in the Content or any part of it;
• Transferring copies of cached Content from an authorized Device to any other Device via any means;
• Reverse-engineering, decompiling, disassembling, modifying, or creating derivative works of the Content or any part thereof except to the extent permitted by applicable law. [If applicable law allows users to decompile any part of the Content where required in order to obtain the information necessary to create an independent program that can be operated with the God Music Service or with another program, the information users obtain from such activities (a) may only be used for the foregoing objective, (b) may not be disclosed or communicated without God Music’s prior written consent to any third party to whom it is not necessary to disclose or communicate in order to achieve that objective, and (c) may not be used to create any software or service that is substantially similar in its expression to any part of the Content];
• Circumventing any technology used by God Music, its licensors, or any third party to protect the Content;
• Selling, renting, sublicensing or leasing the Content;
• Removing or altering any copyright, trademark, or other intellectual property notices contained on the Content (including for the purpose of disguising or changing any indications of the ownership or source of any Content);
• Artificially promoting Content by automated means or otherwise; and
• Tampering with, breaching, or attempting to probe, scan, or test for vulnerabilities in the security components, authentication measures or any other protection measures applicable to the Content or any part thereof.

10. INFRINGEMENT AND REPORTING CONTENT

God Music respects the rights of intellectual property owners. If users believe that any Content infringes their intellectual property rights or other rights, see God Music’s copyright policy. If God Music is notified by a copyright holder, using the forms provided by God Music, that any Content infringes a copyright, God Music may in its sole discretion remove such Content from the Service, or take other steps that God Music deems appropriate, without prior notification to the artist or other party who supplied that Content. If such user or other party believes that the Content is not infringing, he or she may in certain circumstances submit a counter-notification to God Music with a request to restore the removed content, which God Music may or may not honour, in God Music’s sole discretion.

If a user believes that any Content does not comply with the User guidelines, they are requested to notify God Music.

11. SERVICE LIMITATIONS AND MODIFICATIONS

God Music will make reasonable efforts to keep the God Music Service operational. However, certain technical difficulties, maintenance or testing, or updates required to reflect changes in relevant laws and regulatory requirements, may, from time to time, result in temporary interruptions. God Music reserves the right, periodically and at any time, to modify or discontinue, temporarily or permanently, functions and features of the God Music Service, with advance notice where possible, all without liability to users, except where prohibited by law, for valid reasons such as in case of genuine interruption, modification, or discontinuation of the God Music Service or any function or feature thereof, or need to repair, maintain or improve the existing functions or features, or to add new functions or features to the Service, or to implement advancements in science and technology or ensure the operability or the security of the Service, legal and regulatory reasons.

Notwithstanding the foregoing, if users have prepaid fees to God Music for Paid Subscriptions that God Music permanently discontinues prior to the end of the Pre-Paid Period (defined in the Payments, cancellations, and trial section), God Music will refund users the prepaid fees for the Pre-Paid Period after such discontinuation. Users understand, agree, and accept that God Music will make reasonable efforts, although it has no obligation to maintain, support, upgrade, or update the Service, or to provide all or any specific content through the Service. God Music and/or the owners of any Content may, from time to time, remove any such Content from the God Music Service without notice. This section will be enforced to the extent permissible by applicable law.

12. CUSTOMER SUPPORT

For customer support with account-related and payment-related questions (“Customer Support Queries”), please contact us by one of the means mentioned on the God Music website. We will use reasonable endeavours to respond to all Customer Support Queries within a reasonable time frame but we make no promises that any Customer Support Queries will be responded to within any particular time frame and/or that we will be able to answer any such queries.

13. TERM AND TERMINATION

The Agreements will continue to apply to users until terminated by either the user or God Music. However, users acknowledge and agree that the perpetual license granted by them in relation to User Content, including Feedback, is irrevocable and will therefore continue after expiry or termination of any of the Agreements for any reason. God Music may terminate the Agreements or suspend user’s access to the God Music Service at any time, including in the event of the user’s actual or suspected unauthorised use of the God Music Service, non-compliance with the Agreements, or if we withdraw the Services (in which case we shall provide users reasonable notice in advance of doing so). If users or God Music terminate the Agreements, or if God Music suspends user’s access to the God Music Service, the user agrees that God Music shall have no liability or responsibility to them, and God Music will not refund any amounts that they have already paid, to the fullest extent permitted under applicable law. Users may terminate the Agreements at any time. To learn how to terminate a God Music account, users may contact us by one of the means mentioned on the God Music website.

14. WARRANTY DISCLAIMER

Users are expected to understand and agree that the God Music Service is provided “as is” and “as available,” without express or implied warranty or condition of any kind. God Music and all owners of the content make no representations and disclaim any warranties or conditions of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement. Neither God Music nor any owner of content warrants that the God Music Service is free of malware or other harmful components. In addition, God Music makes no representation nor does it warrant, endorse, guarantee, or assume responsibility for any third party applications (or the content thereof), user content, devices or any other product or service advertised, promoted or offered by a third party on or through the God Music Service or any hyperlinked website, or featured in any banner or other advertising. Our content may be directly updated/uploaded on our service by a third party and therefore we make no warranty that users will not come across content that might not suit their sensibilities and might be considered inappropriate by them. In such a scenario, users are free to discontinue or opt not to view/stream/consume such content. Users understand and agree that and God Music is not responsible or liable for any transaction between them and third party providers of the foregoing.

No advice or information whether oral or in writing obtained by users from God Music shall create any warranty on behalf of God Music.

Without limiting the foregoing, nothing in this section shall have the effect of limiting God Music’s liability in the event of total or partial non-performance or inadequate performance of its essential obligations for providing the service under the agreements. This section applies to the fullest extent permitted by applicable law.

This section does not affect users’ statutory rights as a consumer.

15. LIMITATION

Users agree that their sole and exclusive remedy for any problems or dissatisfaction with the God Music Service is to uninstall any God Music software and to stop using the God Music Service. Users agree that God Music has no obligation or liability arising from or related to third party applications or the content thereof made available through or in connection with the God Music Service, and while their relationship with such third party applications may be governed by separate agreements with such third parties, their sole and exclusive remedy, as with respect to God Music, for any problems or dissatisfaction with third party applications or the content thereof, is to uninstall and/or stop using any such third party applications.

In no event will God Music, its officers, shareholders, employees, agents, directors, subsidiaries, affiliates, successors, assigns, suppliers, or licensors be liable for:

• any loss or damage (including any indirect, special, incidental, punitive or exemplary, damages) which is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both God Music and users knew it might;
• any: (a) loss of use; (b) loss of data; (c) loss of business; (d) loss of profits; or (e) damage to devices, to the extent users could have avoided such damage by following our advice to apply updates to the services or content or if such damage is caused by users failing to correctly follow installation instructions or have in place the minimum system requirements advised by us, In all cases arising out of the use of or inability to access the God Music Service, devices, third party applications, or third party application content, regardless of legal theory, without regard to whether God Music has been warned of the possibility of those damages, and even if a remedy fails of its essential purpose;
• aggregate liability for all claims relating to the God Music Service, third party applications, or third party application content more than the amounts paid by users to God Music during the prior twelve months in question; or
• non-performance or inadequate performance or delay to the obligations deriving from the agreements caused by force majeure or any cause which is not reasonably foreseeable or beyond God Music’s reasonable control.

Nothing in the agreements removes or limits God Music’s liability for fraud, fraudulent misrepresentation, death or personal injury caused by its negligence, and, if required by applicable law, gross negligence.

This section applies to the fullest extent permitted by applicable law. Users may have rights under applicable law in their jurisdiction, which provides for remedies in addition to those set out above.
